It is argued that the current policy of the British Medical Association (BMA) on conscientious objection is not aligned with recent human rights developments. These grant a right to conscientious objection to doctors in many more circumstances than the very few recognised by the BMA. However, this wide-ranging right may be overridden if the refusal to accommodate the conscientious objection is proportionate. It is shown that it is very likely that it is lawful to refuse to accommodate conscientious objections that (...) would result in discrimination of protected groups. It is still uncertain, however, in what particular circumstances the objection may be lawfully refused, if it poses risks to the health and safety of patients. The BMA's policy has not caught up with these human rights developments and ought to be changed. (shrink)

This paper argues for a theory of the rule of law that is inclusive of sentient non-human animals. It critiques the rule of law theories of Fuller, Waldron, and Allan, by showing that their theories presuppose that the legal subject is a person who can be guided by legal norms. This unduly excludes non-human animals, as well as certain humans who do not have rational capacities. If we view the basic idea of the rule of law as restraining arbitrary power, (...) then rule of law theories need to give an account of who can be a potential victim of such power. Non-human animals and humans, whether endowed with rational capacities or not, can all be victims of arbitrary power. So, we need a new rule of law theory which is inclusive of all sentient animals, humans and non-human alike. This paper sets out such an inclusive theory. (shrink)

In this philosophically sophisticated and historically significant work, John H. Zammito reconstructs Kant's composition of The Critique of Judgment and reveals that it underwent three major transformations before publication. He shows that Kant not only made his "cognitive" turn, expanding the project from a "Critique of Taste" to a Critique of Judgment but he also made an "ethical" turn. This "ethical" turn was provoked by controversies in German philosophical and religious culture, in particular the writings of Johann Herder and (...) the Sturm und Drang movement in art and science, as well as the related pantheism controversy. Such topicality made the Third Critique pivotal in creating a "Kantian" movement in the 1790s, leading directly to German Idealism and Romanticism. The austerity and grandeur of Kant's philosophical writings sometimes make it hard to recognize them as the products of a historical individual situated in the particular constellation of his time and society. Here Kant emerges as a concrete historical figure struggling to preserve the achievements of cosmopolitan Aufkl-rung against challenges in natural science, religion, and politics in the late 1780s. More specifically Zammito suggests that Kant's Third Critique was animated throughout by a fierce personal rivalry with Herder and by a strong commitment to traditional Christian ideas of God and human moral freedom. He sets the scene by the historical development of scientific research as a profession, the growth of scientific technologies out of the useful arts, the sources of invention and technical innovation, and the advent of Big Science. We are sceptical of concerns over the opacity of algorithmic decision tools. While transparency and explainability are certainly important desiderata in algorithmic governance, we worry that automated decision-making is being held to an unrealistically high standard, possibly owing to an unrealistically high estimate of the degree of transparency attainable from human decision-makers. In this paper, we review evidence demonstrating that much human decision-making is fraught with transparency problems, show in what respects AI fares little worse or better and argue that (...) at least some regulatory proposals for explainable AI could end up setting the bar higher than is necessary or indeed helpful. The demands of practical reason require the justification of action to be pitched at the level of practical reason. Decision tools that support or supplant practical reasoning should not be expected to aim higher than this. We cast this desideratum in terms of Daniel Dennett’s theory of the “intentional stance” and argue that since the justification of action for human purposes takes the form of intentional stance explanation, the justification of algorithmic decisions should take the same form. In practice, this means that the sorts of explanations for algorithmic decisions that are analogous to intentional stance explanations should be preferred over ones that aim at the architectural innards of a decision tool. According to the cognitive penetrability hypothesis, our beliefs, desires, and possibly our emotions literally affect how we see the world. This book elucidates the nature of the cognitive penetrability and impenetrability hypotheses, assesses their plausibility, and explores their philosophical consequences. It connects the topic's multiple strands (the psychological findings, computationalist background, epistemological consequences of cognitive architecture, and recent philosophical developments) at a time when the outcome of many philosophical debates depends on knowing whether and how cognitive states can influence perception. In 1984, John W. Yolton published Perceptual Acquaintance from Descartes to Reid. His most recent book builds on that seminal work and greatly extends its relevance to issues in current philosophical debate. Perception and Reality examines the theories of perception implicit in the work of seventeenth- and eighteenth-century philosophers which centered on the question: How is knowledge of the body possible? That question raises issues of mind-body relation, the way that mentality links with physicality, and the nature of the (...) known world. In contrast to commonsense realism, which suggests that the world is as it appears to be, a more complex theory developed throughout this period. Yolton traces its evolution from Descartes to Kant, via Arnauld, Malebranche, Locke, Berkeley, and Hume. Yolton explains that the new theory postulated two interactive relations between perceivers and the physical world, one physical and causal, the other cognitive. An understanding of this double relation is important for an accurate construction of the history of philosophy. It is also important for contemporary thought because it suggests a way to account for representation (cognitivity) and realism at the same time. (shrink)

The operations of deep networks are widely acknowledged to be inscrutable. The growing field of Explainable AI has emerged in direct response to this problem. However, owing to the nature of the opacity in question, XAI has been forced to prioritise interpretability at the expense of completeness, and even realism, so that its explanations are frequently interpretable without being underpinned by more comprehensive explanations faithful to the way a network computes its predictions. While this has been taken to be a (...) shortcoming of the field of XAI, I argue that it is broadly the right approach to the problem. (shrink)

I critically examine the claim that modal collapse arguments against the traditional doctrine of divine simplicity (DDS) are in general fallacious. In a recent paper, Christopher Tomaszewski alleges that modal collapse arguments against DDS are invalid, owing to illicit substitutions of nonrigid singular terms into intensional contexts. I show that this is not, in general, the case. I show, further, that where existing modal collapse arguments are vulnerable to this charge the arguments can be repaired without any apparent dialectical impropriety. (...) I conclude that the genuine debate over modal collapse and divine simplicity and modal collapse is substantially a controversy over the metaphysics of divine action, and that this constitutes a fruitful direction in which to take future discussions of the subject. Practical wisdom and judgment, rather than seen as ‘things’ hidden inside the mind, are best talked of, we suggest, as emerging developmentally within an unceasing flow of activities, in which practitioners are inextricably immersed. Following a performative line of thinking, we argue that when practitioners (namely, individuals immersed in a practice, experiencing their tasks through the emotions, standards of excellence and moral values the practice engenders or enacts) face a bewildering situation in which they do not know, initially at least, (...) how to proceed, the judgment they exercise emerges out of seeking to establish a new orientation to their puzzling surroundings. They do so through actively trying to be in touch with their felt emotions and moral sensibilities, while attempting to articulate linguistically the feelings experienced in order to get a clearer view of relevant aspects of the situation at hand. Coming to a judgment involves moving around within a landscape of possibilities, and in so doing, being spontaneously responsive to the consequences of each move, and assessing which one (or combination of moves) seems best in resolving the initial tension aroused in one’s initial confusion. The danger of human operators devolving responsibility to machines and failing to detect cases where they fail has been recognised for many years by industrial psychologists and engineers studying the human operators of complex machines. We call it “the control problem”, understood as the tendency of the human within a human–machine control loop to become complacent, over-reliant or unduly diffident when faced with the outputs of a reliable autonomous system. While the control problem has been investigated for some time, up (...) to this point its manifestation in machine learning contexts has not received serious attention. This paper aims to fill that gap. We argue that, except in certain special circumstances, algorithmic decision tools should not be used in high-stakes or safety-critical decisions unless the systems concerned are significantly “better than human” in the relevant domain or subdomain of decision-making. More concretely, we recommend three strategies to address the control problem, the most promising of which involves a complementary coupling between highly proficient algorithmic tools and human agents working alongside one another. We also identify six key principles which all such human–machine systems should reflect in their design. These can serve as a framework both for assessing the viability of any such human–machine system as well as guiding the design and implementation of such systems generally. (shrink)

Nowadays, science is treated an instrument of policy, serving the material interests of government and commerce. Traditionally, however, it also has important non-instrumental social functions, such as the creation of critical scenarios and world pictures, the stimulation of rational attitudes, and the production of enlightened practitioners and independent experts. The transition from academic to ‘post-academic’ science threatens the performance of these functions, which are inconsistent with strictly instrumental modes of knowledge production. In particular, expert objectivity is negated by entanglement with (...) political and commercial interests. We cannot go back to the old academic model for science, but need to consider how to maintain its vital non-instrumental roles. (shrink)

Digital pictures can be type-identical in respect of colours, shapes and sizes (allographic), but they are not tokens of notational systems, because the types under which they are identical have vague limits and do not meet the requirements for notational characters. Digital display devices are designed to instantiate only limited ranges of objective properties (light intensities, sizes and shapes). Those ranges keep differences in objective magnitudes below sensory discrimination thresholds, and thus define objective conditions sufficient, but not necessary, for the (...) phenomenal type-identity of pictures. The fact that digital pictures are types shows that pictures are not necessarily autographic. Moreover, the reasons why digital pictures are allographic (essentially, the consistent manipulation of sub-phenomenal information) could in principle also be made to apply to non-digital pictures. Scientific authorship has become a contested terrain in contemporary science. Based on a survey of authors across fields, we measure the likelihood of specialist authors : people who only made specialized contributions, such as data, materials, or funding; and “nonauthor collaborators” : those who did significant work on the project but do not appear as authors, across different research contexts, including field, size of the project team, commercial orientation, impact of publication, and organization of the collaboration. We find that guest (...) and ghost authors are common, with about one-third of publications having at least one specialist author and over half having at least one nonauthor collaborator. We see significant cross-field variations in both overall rates and types of specialist authors and nonauthor collaborators. We find there are generally fewer specialist authors among highly cited papers and more graduate student nonauthor collaborators in single location projects. The results suggest authorship practices vary across fields, and by project characteristics, complicating the use of authorship lists as a basis for evaluation. We discuss implications of these findings for interpreting author lists in the context of science policy. (shrink)

Very few biographies of Kant exist. The Neo-Kantian movement renewed interest in his life. During the last half of the 19th century, John Henry Wilbrandt Stuckenberg provided an eminently readable biography of Kant, as seen from a sympathetic, yet detached viewpoint.

The presence of a kinship link between nuclear families is the strongest predictor of interhousehold sharing in an indigenous, predominantly Dolgan food-sharing network in northern Russia. Attributes such as the summed number of hunters in paired households also account for much of the variation in sharing between nuclear families. Differences in the number of hunters in partner households, as well as proximity and producer/consumer ratios of households, were investigated with regard to cost-benefit models. The subset of households involved in reciprocal (...) meal sharing is 26 of 84 household host-guest pairs. The frequency of reciprocal meal sharing between families in this subset is positively correlated with average household relatedness. The evolution of cooperation through clustering may illuminate the relationship between kinship and reciprocity at this most intimate level of food sharing. (shrink)

Research scientists are trained to produce specialised bricks of knowledge, but not to look at the whole building. Increasing public concern about the social role of science is forcing science students to think about what they are actually learning to do. What sort of knowledge will they be producing, and how will it be used? Science education now requires serious consideration of these philosophical and ethical questions. But the many different forms of knowledge produced by modern science cannot be covered (...) by any single philosophical principle. Sociology and cognitive psychology are also needed to understand what the sciences have in common and the significance of what they generate. Again, traditional modes of ethical analysis cannot deal adequately with the values, norms and interests activated by present-day technoscience without reference to its sociological, political and economic dimensions.
